1. Acceptance of these terms

This document is a binding agreement between you ("you" or the "User") and BetaCode ("the platform", "we", "us"), and governs your use of the Facebook comment auto-reply service available at https://beta-code.org. By creating an account or using the platform in any way, you acknowledge that you have read and understood these terms and agree to be fully bound by them, together with our Privacy Policy. If you do not agree with any part of these terms, you must stop using the platform immediately.

2. Description of the service

The platform lets owners of Facebook business Pages connect their Pages through Facebook Login and create "campaigns": a specific post paired with a set of pre-written reply texts. The platform then monitors new comments on that post and sends a randomly selected reply text as a private Messenger reply to each commenter, using Facebook's official Private Replies API. The platform is a support tool only, and does not own or manage any Facebook Page or account on your behalf.

3. Eligibility and your account

• You must be a natural person with legal capacity to contract, or an authorized representative of an entity or business, to use the platform.
• You are responsible for the accuracy of the information you provide when creating your account (name and email address), and for keeping it up to date.
• You are solely responsible for keeping your login credentials (password) confidential, and for all activity that occurs through your account, whether or not authorized by you, and you must notify us immediately if you suspect unauthorized use.
• You may not create more than one account for the purpose of circumventing subscription fees or any other restriction stated in these terms.

4. Subscription, fees, and payment

• Using the platform as a regular user (connecting Pages, creating campaigns, and running the auto-reply service) requires a paid subscription, at the price and duration shown to you at the time of subscribing.
• Payment is made through the mechanism described within the platform on the "Subscription" page, and is subject to verification before the subscription is activated or renewed.
• Fees paid are non-refundable unless required otherwise by applicable law, or with our express agreement in exceptional circumstances (such as a clear technical failure on our part that prevented the service from being activated).
• Subscriptions do not renew automatically; when your subscription period ends, the auto-reply service stops until you renew it.
• We reserve the right to change subscription pricing in the future, without affecting the duration of a subscription you have already paid for and activated.
• "Administrator" and "general manager" accounts are exempt from subscription fees given their administrative role in operating the platform.

5. Connecting your Facebook account and Platform compliance

When you connect your Page or Pages through Facebook Login, you grant the platform limited permissions (reading comments on the posts you specify, and sending private Messenger replies on your Page's behalf) using Facebook's official APIs only. This means:

• Your use of Facebook and your Pages remains fully subject to Facebook's own Terms of Service (Meta Terms of Service), the Facebook Community Standards, and the Meta Platform Terms, and you are solely responsible for complying with them.
• You are solely responsible for the content of the reply texts you write and include in your campaigns, and for ensuring they comply with Facebook's policies and applicable law, including that they do not contain misleading, harassing, or otherwise non-compliant content.
• We are not liable for any action Facebook/Meta takes against your Page, account, or its permissions (such as revoking access, restricting the Page, or disabling the account), whether resulting from the content of your replies, your usage patterns, or any decision Facebook makes under its own policies.
• You may disconnect any Page from the platform at any time from your dashboard, which immediately deletes that Page's access token and stops any related auto-reply activity.
• For our part, we commit to using the permissions granted to us strictly within their stated purpose (reading comments and sending private replies), and not for any other purpose such as posting on your behalf or accessing your prior private messages.

6. Acceptable use

While using the platform, you agree not to:

• Use it to send content that is unlawful, abusive, fraudulent, or that infringes the rights of others.
• Use it to send unsolicited spam-like content unrelated to the actual comment that triggered the reply.
• Attempt to gain unauthorized access to other users' accounts, or to the platform's systems or infrastructure.
• Reverse-engineer, decompile, or attempt to extract the platform's source code, except to the extent expressly permitted by law.
• Use the platform in any way that could compromise its availability, security, or integrity, or that violates any provision of Facebook's Platform Policies for developers.

We reserve the right to suspend or terminate any account that violates these provisions, without prior notice in serious cases (such as clear abuse or activity that threatens the security of the platform or other accounts).

7. Your content

Ownership of your reply texts and any other content you enter into the platform (such as post links) remains yours alone. By entering this content, you grant us a limited, non-exclusive license to use it solely to the extent necessary to provide the service you requested (storing it, and sending it as a private reply on your behalf via Facebook's API). We do not use your content for any other purpose, and we do not share it with any third party beyond what is described in our Privacy Policy.

8. Intellectual property

All intellectual property rights in the platform itself — including its design, source code, and the BetaCode brand and logo — are owned by us or licensed to us, and your use of the platform does not grant you any ownership interest in it. No part of the platform may be copied, modified, or distributed without our prior written permission.

9. Service availability

We make reasonable efforts to keep the platform available and operating reliably, but we do not guarantee uninterrupted or error-free availability at all times. The service may be affected by factors beyond our control, such as outages of Facebook's own APIs, scheduled maintenance, or unexpected technical conditions. We reserve the right to modify or temporarily suspend any feature of the platform for maintenance or development purposes, while trying to minimize the impact on users as much as possible.

10. Disclaimers

The platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of fitness for a particular purpose, non-infringement, or the continuous operation of the webhook or the receipt of every comment without exception. We do not guarantee that a private reply will reach every commenter in every case, particularly in circumstances beyond our direct control (such as sudden changes to Facebook's policies or APIs, or a commenter's own privacy settings that prevent them from receiving private messages from the Page).

11. Limitation of liability

To the maximum extent permitted by applicable law, neither we nor our staff or representatives will be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or business opportunities) arising from your use of, or inability to use, the platform, or from any action Facebook takes against your account or Page. In all cases, our total liability to you for any claim will not exceed the subscription fees you actually paid during the three months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these terms, your use of the platform in violation of law or of Facebook's policies, or the content of the reply texts you included in your campaigns.

13. Suspension and termination

• You may stop using the platform at any time by disconnecting your Pages and not renewing your subscription.
• You may request permanent deletion of your account and all associated data, per our Data Deletion Instructions.
• We reserve the right to suspend or terminate your access to the platform, in whole or in part, in the event of a material breach of these terms, or usage that endangers the platform, other users, or our relationship with Facebook.
• When an account is terminated for any reason, the auto-reply service stops immediately, and fees already paid for the remaining subscription period are not refunded except as described in Section 4 above.

14. Changes to the service and these terms

We may update these terms from time to time to reflect a change in the service, legal requirements, or Facebook's policies. Any material change will be posted on this page along with an updated "last updated" date above, and we will notify you of any material change via the email address registered to your account. Your continued use of the platform after a change is posted constitutes acceptance of it. We also reserve the right to add, modify, or discontinue any feature of the platform as part of its ongoing development.

15. Governing law and disputes

These terms are governed by and construed in accordance with the laws of the Syrian Arab Republic, without regard to conflict-of-law principles. Any dispute arising from these terms or from your use of the platform will first be addressed through good-faith negotiation by contacting us using the details below, and failing that, will be subject to the competent courts of the Syrian Arab Republic.

16. General provisions

• If any provision of these terms is found to be unenforceable or contrary to law, the remaining provisions will remain in full force and effect.
• Our failure to exercise any right under these terms does not constitute a waiver of that right.
• You may not assign your rights or obligations under these terms to any third party without our prior written consent.
• These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the platform, and supersede any prior agreement or understanding on the same subject.
